Innovation Platform privacy policy

SoftServe Inc. (“SoftServe”, “we”, “us” or “our”) built the Innovation Platform (web site(s), mobile app(s) and any software provided on or in connection with Innovation Platform services, i.e. the “Services”) as a commercial product intended for use by Organizations (“Customer” or “Customers”) and in accordance with their instructions. Our Privacy Policy explains how we collect, use, share, and protect your information in relation to our Services.

The Services are currently available for use via a web browser and mobile application. If you (“User”) are using the Services on a device or web site using account issued to you by your employer or another organization (your “Organization” or “Customer”), then that Organization might have its own policies regarding storage, access, modification, deletion, and retention of data that you submit or provide through the Services.

Thus, your Organization has the right to control and manage your Innovation Platform account (“Your Account”) along with accessing and processing any data that you submit or provide through the Services (e.g. files and communications). In case of any questions regarding policies your Organization has in place about your use of the Services, please reach out to your Organization.

Information we collect

We collect and use your information as described further on behalf of your Organization when you, your co-workers, or other users access/use the Services to provide, understand, and improve our Services.

Customer data

Content and information submitted by users to the Services is referred to in this policy as “Customer Data.” Through the use of the Services, you, your co-workers, your Organization, and other users, will directly provide information to SoftServe Inc. ("Customer Data"). When SoftServe Inc. collects or processes Customer Data, it does so on behalf of the Customer. If you are using the Services by invitation of a Customer (whether that Customer is your employer, another organization, or an individual) that Customer decides its own policies regarding access, storage, modification, sharing, deletion, and retention of Customer Data which may apply to your use of the Services. Please clarify with the Customer regarding their policies and settings.

Log and cookie information

When you use Mobile App and/or our Website, we may use cookies and other secure tracking technologies for a variety of purposes. These helps to enhance your experience, such as remembering your login status and viewing preferences from a previous use of our App or Website when you return later.

We automatically collect certain information on your Organization’s behalf through the Services, for example your Internet protocol (IP) address and other browser or device identifiers, operating system, browser type, crash data, Internet service provider (ISP), the date and time of your visit, information about your activities (such as the links you click and pages you view) within the Services, and other standard server-log information (“Log and Cookie Data”).

To supply the Services on behalf of your Organization, we may use cookies, local cache in web browsers and mobile devices, pixel tags, and similar technologies to automatically collect this information.

We also receive information from our third-party partners on your Organization’s behalf for some of the purposes described further.

How we share information

We may disclose your information in the limited circumstances and as approved by your Organization. This section discusses how SoftServe may share such information. Customers determine their own policies of sharing and disclosure of Customer Data. SoftServe does not control how Customers or their third parties share or disclose Customer Data.

We may share the information in the following cases:

Legal requests

We may access, preserve, and share your information in response to a legal request like a search warrant, court order, subpoena, or other legal requests relating to the Services (collectively a “Legal Request”) and if we have a good faith belief that the law requires us to do so. We will make effort to address the requesting party to obtain the data directly from your Organization. If we ask the requesting party to address the request to the Organization, we will provide your Organization’s contact information to the requesting party. If legally forced to provide information and unless legally prohibited, we will use reasonable efforts to notify your Organization so that they can notify you pursuant to your Organization’s policies and as permitted by law. We will direct any requests for information under data protection laws to your Organization, unless prohibited by law.

Aggregate or de-identified information

We may also disclose aggregated data that does not personally identify you to third parties and affiliates who may use it for analytics and trends to improve and provide Services. This will also help us provide more useful information to our customers and to understand which parts of our website, products, and services are of most interest.

Safety and security

SoftServe takes security seriously. We use the information we have to help verify accounts and activity, and to promote safety and security on and off of our Service on your Organization’s behalf. For example, investigating suspicious activity or violations of our policies. We have implemented appropriate organizational and technical measures to help us keep your information secure, current, accurate, and complete.

Information accessing and modifying

You and your Organization may access, modify, or delete information that you have provided to the Service by using the tools and account settings within the Service on behalf of your Organization. If there is no possibility to do this by the tools provided on the Service, contact your Organization directly to access or modify your data.

Changes that you make to your information on the Service take immediate effect on your specific network, but data will be retained by SoftServe in backup copies for a commercially reasonable amount of time and as directed by your Organization.

Third-party websites and services

The Services may contain links to content managed by third parties that we cannot not control. Please remember that when you use a link to go from our Service to another website or service, our Privacy Policy does not apply to those third-party websites or services. Your browsing and interaction on any third-party website or service, including those that have a link on our website, are subject to that third party's own rules and policies. In addition, you agree that we are not responsible and do not have control over any third-parties that you authorize to access your Customer Data. If you are using a third-party website or service and you allow them to access your Customer Data you do so at your own risk as we are not responsible for the privacy practices of these third parties. Thus, we recommend that you check privacy policies of each website that you visit.

Account closure

In case you stop working for or with the Organization, the Organization may suspend Your Account. Likewise, if you choose to stop using the Services, you should reach out to your Organization to close your account.

It may take some time to delete an account on behalf of your Organization. All content that you create on the Services is owned by your Organization thus may remain on the Services and be accessible even if Your Account has been deactivated. For example, information that you have shared with others will remain visible after you closed your account or deleted the information from your own profile. We do not control data that your co-workers copied out of our Services. We may also retain de-personalized information after your account has been closed.

Children’s privacy

Services are not directed to children under 16. If you learn that a child under 16 has provided us with personal information without consent, please contact us.

Changes to our privacy policy

We may modify or update this Privacy Policy from time to time, so please review it periodically. When we update our Privacy Policy, we change the “Effective date”. Your continued use of the Services after any modification to this Privacy Policy will constitute your acceptance of such modification.
